Kid "CEO for the Day" Official Rules

NO PURCHASE, TEXT MESSAGE, OR PAYMENT NECESSARY TO ENTER.  A purchase, payment, or text message of any kind will not increase your chances of winning. We appreciate your interest in submitting your child’s video (as described below) for use by Crayola Experience, its subsidiaries, and affiliates ("CE") through this Crayola Experience “CEO for the Day Promotion” (the "Promotion").  These are the official rules governing the Promotion.  All references herein to “you” apply to the adult submitting the Promotion entry (the “Applicant”), and the Applicant shall be the parent or legal guardian of the child featured in the Applicant’s video submission (the “Entrant”).

By submitting to CE (through the application process) materials in response to the Promotion prompt (including photography, video, text, commentary, illustration, and other submission content) relating to proposed or current attractions, exhibits, entertainment, product offerings, innovation, employment, promotional activities, consumer engagement programs, regional or national exhibitions, and other CE testing and feedback  (the "Materials"), and in consideration for the opportunity to have your video submission considered by CE, you understand and agree to be bound by the following terms and conditions:

 

1. The Promotion:  The Promotion will open on March 2, 2020, at 8 a.m. ET, and will close on June 26, 2020, at 11:59 p.m. ET (the “Promotion Entry Period”), and CE in Easton, Pennsylvania, will serve as the official time keeper for the Promotion.  Video submissions shall be judged by the CE at the close of the Promotion Period.  With respect to only the CE attractions located in Arizona, Florida, Minnesota, Pennsylvania, and Texas, one winner per CE Location will be determined from all entries received within the Promotion Entry Period, for a total of five winners.  Each winner will be awarded the temporary title of “CEO for the Day” for the respective CE Location for which the winner is selected.  As CEO for the Day, the winner will receive particular prizes at each location, including on-site visit experiences, a gift card of $250 for use at the Crayola Store, a pre-release package of 2020 Crayola merchandise prior to general public release, four (4) Gold Fusion annual passes to the respective CE location, and a single visit admission ticket to the respective CE location for every student in the winner’s school (the “Promotion Details”).  Prizes are further defined below in Section 6. CE, in its sole discretion, may shorten or extend any opening or closing times for submissions and may supplement any evaluation criteria or awards or other Promotion Details. All entries must be submitted as required by the Promotion Details and in these Official Rules. An entry constitutes acceptance of these Official Rules.

 

2. Eligibility:  Except where prohibited by law, the Promotion is open to Applicants and Entrants who are legal residents of the continental United States and who reside within 150 miles of the CE location for which he or she is submitting the application (addresses available at crayolaexperience.com). Applicants must be 18 or older and must be a parent or legal guardian of the Entrant. Entrants must be between 6 and 12 years of age as of March 2, 2020.  Employees, officers, and directors (including immediate family members and members of the same household) of CE, prize suppliers, agents, and their respective parents, affiliated companies, subsidiaries, and advertising and promotion agencies, and any other entities associated with this Promotion are also not eligible to participate. The Promotion is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Applicant’s full and unconditional agreement to these Official Rules, as well as CE’s decisions and/or interpretations under these Official Rules, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

3.  Sponsor and Administrator:  CE is sponsoring this Promotion, and has its principal headquarters at 30 Centre Square, Easton, Pennsylvania, 18042. Trymark Consulting Group LLC (“Administrator”) is the administrator of the Promotion. CE may share Applicant and Entrant information and entry Materials with the Administrator to facilitate selection and notification of the Promotion winner.

 

4.  How to Enter:  During the Promotion Entry Period, Entrants must access the web portal located at crayolexperience.com/KidCEO, and complete and submit the application form including providing a link to a video recording (the “Video”) on one of the following media channels, Instagram, YouTube or Vimeo, as further described below. Each application must be submitted according to the community guidelines, terms of use, and other platform policies associated with the channel used by Applicant for public submission.  The Video must be in English and a minimum of 30 seconds and a maximum of 90 seconds in length of the Applicant’s child subject answering the Promotion question: “What makes you the best choice for Chief Experience Officer of Crayola Experience? Please share your idea for how to make Crayola Experience even more fun with a new, creative activity, attraction or exhibit.” The Video must be publicly accessible and cannot be edited post-submission. Applicant is required to provide a digital copy of the Video to CE if selected as a winner.  Eligible Video must not contain any content that includes copyrighted or trademarked or other intellectual property rights of third parties including but not limited to text, images, and music; vulgar, profane, violent, or political language or images; other persons besides the Entrant; or material that violates any applicable law. To register, Applicant will be required to provide their first name, last name, phone number, address of residence, and email address, as well as the first name and date of birth of the Entrant.  Use of any automated system to participate is prohibited and will result in disqualification. Entrants may only use one email address in connection with this Promotion.  Use of multiple email accounts to enter by the same individual is prohibited and may result in disqualification. Limit one Video submission per Entrant regardless of Applicant. CE is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Video links, which will be disqualified. CE, in its sole discretion, has the right to reject any entry.

 

Applicants acknowledge that the Promotion is in no way endorsed, sponsored or administered by, or associated with Instagram, YouTube, Vimeo or Facebook, or their shareholders, affiliates or subsidiaries. Applicant also releases Instagram, YouTube, Vimeo and Facebook, their shareholders, affiliates or subsidiaries of any liability or responsibility for any claim arising in connection with participation in this Promotion or any prize awarded. If you do not have a Instagram, YouTube or Vimeo account, you may sign up for a free account by clicking on the link of the platform you wish to join. By submitting your information and creating an account, you will be required to agree to that specific platform’s terms of service and privacy policy: Instagram, YouTube, Vimeo. Submissions that do not comply with these terms will be disqualified. Data charges may apply if you are accessing any of these accounts from your mobile phone to enter this Promotion. If you deactivate your account at any time prior to the end of the Promotion Period, your Entry will be void.

 

5.  Selection of Winners:  After the close of the Promotion, CE will select one winner per CE location based on Video content, including the Entrant’s response to the Promotion question. The content will be judged with equal weight based on:

a)      Personality – Embodying the Crayola spirit, engaging, positive attitude, charismatic, expressive;

b)      Presentation – Good delivery, expressive, fun, descriptive; and

c)      Idea – Imaginative, creative, different/original, tied to the Crayola brand.

In the event of a tie, the Senior Vice President of Crayola Experience will choose the winning video based on the above criteria.

Winners are required to sign an affidavit of eligibility, a publicity and liability release, an assignment of rights to the video content, and any additional documentation required to formalize the Applicant’s entry, and provide a digital copy of the video submission. Additional documentation may be required prior to disclosure of CE confidential information. Winners will be notified by July 17, 2020, and are required to return the appropriate documentation within three (3) days of contact or CE reserves the right to disqualify the Winner and offer the prize to the Entrant with the next highest judging score.

 

6.  Prize for Each Winner:  Each Entrant with a winning video will be invited to visit, with the Applicant, the CE location within 150-mile radius of their residence. The date of the visit will be mutually agreed upon between the applicable CE location and the Applicant and occur within a reasonable amount of time. Winners are responsible for their own transportation to and from the CE location. During the visit, the winner will be invited to:

a)    test and provide feedback on current and future CE exhibits;

b)    provide ideas on marketing events and seasonal activities;

c)    provide feedback on potential new products and retail displays for the Crayola Store;

d)    name a limited run crayon wrapper for retail distribution at the CE location;

e)    decide on change-outs for existing attractions such as the next set of colors to be used in the Wrap It Up! attraction and molds to be used in the Melt & Mold attraction;

f)     help develop a new Be A Star attraction background; and

g)    participate in manager and staff meetings.

The winner also will receive:

a)    a $250 CE gift card, which is redeemable only for merchandise and admission at CE locations and crayolaexperience.com. The card may not be redeemed for cash;

b)    four (4) Gold Fusion Annual Passes with a retail value of $180. An annual pass is valid at all CE locations in the United States. It is not valid during private events or special events to which additional admission fee is charged. The pass is valid for one visit per day, a hand stamp is required for reentry. The pass is valid for one (1) year from date of issue. It is non-transferable, non-refundable and non-exchangeable and is the property of the Crayola Experience. Use of the pass by anyone other than the individual to whom it is issued is strictly prohibited and will result in revocation of the pass without compensation. The pass holder is required to comply with CE safety rules. CE may refuse admission or expel any person whose conduct is objectionable. Each guest assumes the inherent risk associated with operation of all attractions. Read and obey all safety signage. CE is not responsible for lost or stolen passes. CE reserves the right to be closed to the public for private events and capacity limitations; 

c)    a package of Crayola 2020 products before they are available to the general public with a retail value of $100;

d)    a customized 2 lb. crayon with a retail value of $24.99;

e)    Crayola Experience business cards with the winner’s name;

f)     a plaque hung at the CE location acknowledging the winner; and

g)    a prize for the winner’s school consisting of a visit from the CE crayon mascot and a general admission ticket for every student enrolled in the school under the age of 14 with the number of tickets per CE location not to exceed 650. CE will determine the distribution of tickets.

Each winner’s prize package has a total approximate retail value of $600. Winners are responsible for any applicable taxes.

 

7. You agree that CE may reproduce and show, display and transmit in physical or digital form the Applicant’s and Entrant’s name and likeness and any Video content, and associate Materials with the first name, age and state of residence of the Entrant, whether the child featured in your Video is selected as a winner, potential winner or not selected, in connection with the Promotion for which the Video was submitted or for any other Promotion in order to promote, market, explain or discuss CE Promotions. By virtue of Applicant’s entry, CE is granted a perpetual license and reserves all rights to use and modify the Video (including text and images) for educational, demonstration, and/or promotional purposes, in any media, worldwide and in perpetuity, without further compensation to you and your heirs.

 

8. You understand that CE is engaged in the business of creativity, entertainment, education, and other products and services, and is otherwise continuously working to improve our products, packaging and processes and that persons, including CE's own employees or contractors, may have submitted to CE or to others, or may in the future originate and submit, ideas and/or Materials which may have writing, graphics, drawings, visual design, ideas, functions, features or other aspects that are similar or identical to the ideas, functions, features or other aspects of the Materials and/or Video. We hope you will understand that the intent of this policy is to avoid misunderstandings when projects developed by CE's very productive staff are similar to someone else's creative work (and possibly yours). Accordingly, as a condition of entering, you release CE from any and all claims, liability or causes of action arising from or related to the Materials and/or Video, and you will not be entitled to any compensation from CE with respect to your Entry, including the submitted Materials and/or Video, other than as provided to winners of each Promotion.

 

9. You agree and understand that you are submitting the feedback Materials on a NON-CONFIDENTIAL basis, and agree that CE will not be obligated to keep secret any information contained in the Materials, and CE is under no obligation of confidentiality or non-use regarding any aspect of the Materials. No contract, obligation or agreement to adopt or compensate you for the use of Materials or requirement to negotiate regarding the Materials is to be implied from CE's consideration or review of the Materials.

You further acknowledge and understand that neither the Applicant or the Entrant are employees of CE, its affiliates, or its subsidiaries, and that this Agreement shall not be construed to create any association, partnership, joint venture, employment, or agency relationship between you and CE for any purpose. You have no authority (and shall not hold yourself out as having authority) to bind CE and you shall not make any agreements or representations on CE’s behalf. 

 

10. You represent and warrant that (i) you are at least eighteen (18) years of age as of the Beginning Date of this Competition; (ii) the Video and any Material submitted in association with the Promotion are original to the Applicant and Entrant, and the Applicant/Entrant are the sole owner, creator, inventor and/or author of the Materials; (iii) CE's use of the Materials, as contemplated by its request for submission of Materials, do not infringe the rights of any third parties (including copyright, trademark, rights of likeness and rights of publicity), and that you have all rights and permissions necessary for CE's use of the Materials; (iv) you have full right and authorization to submit the Materials and that no other person or entity has or shall have any right, title or interest in or to the Materials; and (v) the Materials (including other photographs, drawings or illustrations substantially similar to the Materials or those depicting the same subject matter from the same photo shoot) (collectively the "Similar Materials"), have not been used, or permitted to be used, for publicly available commercial purposes, including but not limited to greeting cards and advertisements. You also agree that if your Material is selected an actual winner, you will not use, or allow someone else to use, the Similar Materials for publicly available commercial purposes, including, but not limited to, greeting cards or advertisements.

 

11.  CE is not responsible for lost, stolen, illegible, misdirected or late submissions. CE assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kind, delayed computer transmissions or network connection problems that are human or technical in nature. CE reserves the right in its sole discretion to cancel or suspend the Promotion, in its entirety or only in part, should any virus, bug, tampering, unauthorized intervention, fraud, technical failures or other causes impact the administration, security or integrity of the Promotion.

 

12. This Agreement sets forth the entire understanding and agreement of the parties with respect to the subject matter hereof and supersedes all other oral or written representations and understandings. This Agreement shall be governed by the laws of the State of Pennsylvania without regard to the principles of conflicts of laws and may not be amended, modified or waived except in a written document signed by you and CE.
